This policy explains when Sufficient Software (Pty) Ltd (Sufficient Software, we) refunds payments for EvoBot and how you can cancel. It forms part of the Terms of Service. Nothing in it limits rights you have under the Consumer Protection Act, 2008 or the Electronic Communications and Transactions Act, 2002 where those Acts apply to you.

1. How EvoBot is paid for

  1. EvoBot is paid for in advance with credits bought in South African rand through Paystack. There is no subscription, no fixed term and no automatic renewal: you are only charged when you choose to buy credits.
  2. Each question uses credits for the AI processing it needs, as explained in section 6 of the Terms. Credits used on a question, including a question that could not be fully answered after the AI worked on it, cover a service already delivered and are not refunded.
  3. Questions that never reach the AI, for example because the agent is offline, a credit limit was reached or the request was refused before processing, are not charged.

2. How long credits are valid

  1. Purchased credits are valid for 90 days after your most recent credit purchase. Each new purchase restarts the 90 days for all the purchased credits on your account, so credits stay valid for as long as you keep buying at least once every 90 days.
  2. We may, but do not have to, remove purchased credits once they are no longer valid. If we do not remove them straight away, that does not extend their validity.
  3. Changes to EvoBot. We keep developing EvoBot and may change how it works. If EvoBot were ever withdrawn as a whole, account owners would get at least 90 days' notice by email and in the portal, so that credits can be used during that time. Credits still unused at the end of the notice period then lapse and are not refunded, except where the law requires otherwise.
  4. Free and promotional credits can have their own, shorter validity, shown when they are granted.

3. When we refund

We refund the amount paid, in full, in these cases:

  1. Unused credits within 7 days. You may ask for a refund of a credit purchase within 7 days of paying, as long as none of the credits from that purchase have been used. If some have been used, the purchase is no longer eligible under this item.
  2. Payment errors. You were charged more than once for the same purchase, or you were charged but the credits were not added to your account.
  3. Our error. Credits were used because of a fault in EvoBot that we confirm, for example a question charged twice. We restore those credits to your account or, if you prefer, refund their value.
  4. We close your account. If we close your account without you being in breach of the Terms, while EvoBot is still offered, we refund the value of your unused, valid purchased credits. This does not apply when EvoBot is withdrawn as a whole; section 2.3 applies instead.
  5. Where the law requires it. Any other refund the law requires.

4. When we do not refund

  1. Credits that have been used, including on answers you were not satisfied with. AI answers can be wrong, as explained in section 2 of the Terms; please check important figures in Sage Evolution.
  2. Unused purchased credits after the 7-day period in section 3.1, unless another item in section 3 applies.
  3. Credits that are no longer valid under section 2, including credits still unused at the end of a notice period under section 2.3.
  4. Free or promotional credits that we granted without payment, including credits that have expired.
  5. Accounts suspended or closed because of a breach of the Terms, including the acceptable use rules.
  6. Problems on your side that stop EvoBot from working, such as your server, network, SQL Server or Sage Evolution being unavailable. Questions that cannot reach your agent are not charged.
  7. Refunds of less than R10. Because of payment processing costs, we do not pay out refunds of less than R10 in total for a payment. Where we owe you such an amount under section 3, we add credits of the same value to your account instead. This does not apply where the law requires us to refund the money to you; we then refund it whatever the amount.

5. How to ask for a refund

  1. Email info@evobot.co.za from the account owner's email address, with your company name, the date and amount of the payment and the reason for the refund.
  2. We reply within 5 business days. If we approve the refund, we remove the refunded credits from your account and Paystack returns the money to the card or account you paid with. Your bank may take a further 5 to 10 business days to show it.
  3. Refunds are paid only to the original payment method and in rand. Where VAT was charged, the refund includes it and we issue a credit note.
  4. Please contact us before disputing a payment with your bank. A chargeback on a payment we would have refunded delays the process, and we may suspend the account while a dispute is open.

6. Cancelling

  1. Stopping use. Because there is no subscription, there is nothing to cancel to stop being charged: simply stop buying credits. Unused credits stay on your account while it is open and they are valid (section 2).
  2. Closing your account. The account owner can ask us to close the account at any time by emailing info@evobot.co.za. Unused purchased credits are forfeited when the account closes, unless they qualify for a refund under section 3; ask for that refund before closing.
  3. After closing. Access ends for every member of the account. Stop the EvoBot agent and uninstall it from your server (Apps & Features, or the uninstall script). We delete or return your data as described in the Privacy Policy, except records we must keep, such as invoices.
  4. Removing team members. Removing a member stops their access straight away and does not change the account's credits.
